Client Service Agreement / Terms of Service
This agreement governs services provided by Coast Haven Real Estate Media (“Provider”) to the client (“Client”). By booking services, the Client agrees to the following terms.
1. Property Information and Pricing
Pricing is based on the property details provided at the time of booking, including but not limited to square footage, property size, layout, and the presence of additional structures.
If material differences exist between the information provided and the property as presented at the time of the shoot, the Provider reserves the right to adjust pricing accordingly.
Detached or secondary structures, including guest suites, carriage homes, shops, and outbuildings, are not included unless explicitly stated.
2. Property Readiness
The property must be fully prepared prior to the scheduled appointment. Preparation includes cleaning, decluttering, staging, and ensuring all areas are accessible and photo-ready.
The Provider is responsible solely for media capture and does not provide cleaning, staging, decluttering, or furniture moving services.
If the property is not ready upon arrival, coverage may be limited. Excessive delays may result in additional charges.
3. Property Staging and Presentation
The Provider will capture the property as presented at the time of arrival.
Services do not include rearranging furniture, removing clutter, or modifying the property’s physical presentation.
Unprepared or unsuitable areas may be excluded from capture at the Provider’s discretion.
4. Property Access and Conditions
The Client is responsible for ensuring access to the property at the scheduled time.
Whenever possible, the property should be vacant during media capture. If occupants are present, they must avoid entering active shooting areas.
The Provider is not responsible for incomplete coverage resulting from restricted access, interference, or site conditions.
5. Capture Time and Coverage
Adequate time must be allocated for proper media capture.
Rushed appointments, early termination of access, or interruptions may impact image count, shot selection, and final results.
Coverage decisions are made at the Provider’s discretion to best represent the property.
6. Editing and Revisions
Standard editing includes exposure correction, colour correction, perspective adjustment, and minor blemish cleanup.
Requests involving object removal, virtual staging, twilight conversions, room clearing, or major visual alterations are considered advanced editing services and are billed separately.
Additional edits requested after delivery will be priced accordingly.
7. Turnaround Times
Typical delivery timelines are as follows:
Photography and floor plans: evening of the shoot or next business day
Matterport or virtual tours: 24 to 48 hours
Video services: 2 to 4 business days
Turnaround times may vary based on workload and project complexity.
8. Payment Terms
Payment is due upon delivery unless otherwise agreed in writing.
eTransfer is preferred unless alternative payment arrangements are made.
The Provider reserves the right to suspend download access for overdue invoices.
All media remains the property of the Provider until payment is received in full.
9. Cancellations and Rescheduling
A minimum of 24 hours’ notice is requested for cancellations or rescheduling.
Late cancellations may be subject to a cancellation fee.
Weather-related drone rescheduling will be accommodated when reasonably possible.
10. Usage Rights
Upon full payment, the Client is granted a non-exclusive license to use the media for marketing the specific property for which the services were commissioned.
Media may not be sold, transferred, licensed, or reused for other properties without written permission.
The Provider retains copyright ownership and the right to use the media for portfolio, marketing, and promotional purposes unless otherwise agreed.
11. Floor Plans and Measurements
Floor plans and measurements are approximate and provided for marketing purposes only.
The Provider makes no guarantees regarding measurement accuracy. Buyers and interested parties should verify measurements if material.
12. Limitation of Liability
The Provider shall not be liable for indirect or consequential damages, including but not limited to listing performance, marketing outcomes, or third-party platform issues.
Liability, if any, is limited to the cost of services provided.
13. General Terms
The Provider reserves the right to refuse or discontinue services where site conditions, safety concerns, or property readiness issues prevent proper execution.
This agreement constitutes the entire understanding between the parties and supersedes prior discussions or representations.
